These Terms of Service ("Terms") are an agreement between you and JIANJIN FU ("we", "us", or "the developer") governing your use of the Memory Palace mobile application and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Memory Palace is a Method of Loci ("memory palace") application that lets you create memory palaces, add ordered loci, attach text, photos, and supported panoramas, arrange them into a route, and review that route. Features may be added, changed, or removed over time.
To use certain features you must create an account. You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity that occurs under your account. You must be at least 13 years old, and old enough under the laws of your jurisdiction to enter into a binding agreement, to use the Service. Please notify us promptly of any unauthorized use of your account.
You retain ownership of the palaces, loci, images, and other content you create in the Service ("Your Content"). You grant us a limited, non-exclusive, royalty-free license to store, process, transmit, and display Your Content solely to operate and provide the Service to you — for example, to back up and sync Your Content across your devices. If you choose to use community or sharing features, you grant the additional permissions described in the app and in our Privacy Policy. You are responsible for Your Content and represent that you have the necessary rights to it.
The Service offers an optional auto-renewing "Premium" subscription, sold through the Apple App Store and Google Play. Payment is charged to your store account when you confirm the purchase. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription in your App Store or Google Play account settings. Prices are shown in the app at the time of purchase and may vary by region. Except where required by law or by the applicable store's policy, payments are non-refundable, and refunds are handled by the store, not by us.
You agree not to misuse the Service. In particular, you will not: use the Service for any unlawful purpose; infringe the intellectual property or privacy rights of others; upload unlawful, harmful, or infringing content; attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its systems; or use the Service in any way that violates these Terms or applicable law.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that Your Content will always be preserved; you should keep your own copies of important material. To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service.
You may stop using the Service and delete your account at any time from within the app (Settings → Account → Delete Account) or through our account deletion page. Deletion removes your active account and associated private content through the process and subject to the limited retention described in our Privacy Policy. Deleting your account does not cancel or refund an Apple App Store or Google Play subscription; manage the subscription separately through the applicable store. We may suspend or terminate your access if you violate these Terms or if required to do so by law.
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. Your continued use of the Service after the changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the People's Republic of China, without regard to its conflict-of-laws rules. Subject to the following sentence, any dispute arising out of or relating to these Terms or the Service shall be submitted to the competent People's Court at the place where the developer is domiciled. If you are a consumer, nothing in this section deprives you of the protection of the mandatory consumer-protection laws of your country of residence, and you may be entitled to bring proceedings in the courts of that country.
